So, "Is Hillary Clinton Unconstitutional?" In a word, Yes -- or, to be more precise, a Secretary of State Hillary Clinton would be unconstitutional.
The Emoluments Clause of Article I, section 6 provides "No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been encreased during such time." As I understand it, President Bush's executive order from earlier this year "encreased" the "Emoluments" (salary) of the office of Secretary of State. Last I checked, Hillary Clinton was an elected Senator from New York at the time. Were she to be appointed to the civil Office of Secretary of State, she would be being appointed to an office for which "the Emoluments whereof shall have been encreased" during the time for which she was elected to serve as Senator. The plain language of the Emoluments Clause would thus appear to bar her appointment ... if the Constitution is taken seriously (which it more than occasionally isn't on these matters, of course).

Why should you care? By Executive Order dated January 4, 2008, President Bush ordered the salaries of Cabinet Secretaries to be raised from $186,600 to $191,300. And Sen. Clinton's current term runs from 2007 through 2012. As such, umm, we've got a slight problem.
This has, as you may have suspected, happened before. In 1909, President Taft sought to nominate Sen. Philander Knox (R-PA) to be his Secretary of State, despite the position's pay having been hiked during his term. As the NYT reported on Feb. 11, 1909, "With President-elect Taft rests the decision in the queer constitutional tangle that threatens to prevent the accession of Senator Knox to the Cabinet. In 1973, President Nixon nominated Sen. William Saxbe (R-OH) to serve as his Attorney General after the Saturday Night Massacre, but the AG's salary had been increased in 1969 during Saxbe's term. Nixon persuaded Congress to lower Saxbe's salary to the pre-1969 level, and the "Saxbe fix" was born.
This was not without objection. Sen. Robert Byrd (D-WV) was opposed, saying that the Constitution was explicit and "we should not delude the American people into thinking a way can be found around the constitutional obstacle." In the 1950s, George Herbert Walker Bush got into the oil business with his partners, the Liedtke brothers. Bush was assisted by his father, Prescott Bush, Sr., who was one of Adolph Hitler's bankers jointly with the Bush relative, George Herbert Walker.
Also greatly assisting Bush was Eugene Meyer who had reportedly built up his fortune by massive fraud misusing Liberty War Bonds, used to suck money out of common Americans with the then new, conspiratorial Federal Reserve, all used to finance and force Americans to fight in England and Europe's bloodbath, World War One. With his loot, Meyer bought the then failing Washington Post newspaper. Meyer's daughter, Katherine Graham, became publicly known as if she were the sole "owner" of the Post, despite the fact that British royalty had a large financial interest in the Post and later, sister publication Newsweek Magazine. Suppressed was the first edition of a book that showed the Washington Post was a front for the American CIA, Deborah Davis' book "Katherine the Great".
Much later, Bush brought in numerous British royalty into his oil ventures. Later, Bush was given honorary title by the Queen. Yet, the U.S. Constitution, Article 1, Section 9, forbids U.S. officials to have titles of nobility and be beholden to foreign kings and princes.

The head gardener, John Walquist, was making his Saturday afternoon rounds at 3:30 PM on November 20, 1915. About fifty feet from the house, on the south driveway, he found a package containing four one-pound sticks of dynamite.

The Tarrytown police believed that the bomb was the work of the International Workers of the World (the I.W.W.—the "Wobblies") and that the assassination attempt was precipitated by the execution of Joseph Hillstrom in Salt Lake City the day before. "Joe Hill" was an I.W.W. member and writer of working class songs who wrote on the eve of his death by firing squad, "Don't waste any time mourning—organize!" A year and a half earlier the I.W.W. had been to Tarrytown on two occasions, protesting the industrial policies of the John D. Rockefellers—junior and senior. This was followed by a fatal explosion at an illicit bomb factory in New York. The Tarrytown police combed the countryside for the bomber; armed guards were posted at the Archbold home, and security was tightened at other Tarrytown estates.

In May 2003, the process of discovery, in which each side seeks documents from the other, got under way. As is common in pretrial fencing, Morgan Stanley resisted some requests. The firm said it would be an invasion of privacy to hand over the personnel files of employees on the Sunbeam account, including William Strong, the account's top banker. Judge Maass sided in part with Morgan Stanley and limited the request to any documents about the employees' "truthfulness, veracity, or moral turpitude."
Unbeknownst to the Perelman team, Mr. Strong had been tried on bribery charges in Italy in the 1990s stemming from a previous job with Salomon Brothers. He was acquitted after a trial, while working for Morgan Stanley, but the firm didn't produce any documents on the matter. Mr. Perelman's lawyers stumbled across a news clipping in early 2005 while researching the case. Morgan Stanley said the information wasn't in Mr. Strong's personnel file and wasn't subject to discovery. The judge said there was "no excuse" for not providing documents about the Italian charges and found that Morgan Stanley "purposefully withheld" the information.

And Mum she recounts a story from one of the black women she saw as a patient, a black woman called Marsha and who had a white mother and a black father, a woman who was very successful in her working life but somehow is lonely and unhappy and who describes herself as “a typical evil nigger bitch”13. Anyway this woman patient thought that her mother had died when she was a baby and that this was the cause of the fact that she was inconsolable as a baby. But through her therapeutic work with Kathleen Pogue White she was to learn a terrible biographical truth Mum. A truth rooted in her birth mother’s inability to do those daily negotiations of family – and other - racism that Frances Winddance Twine14 found some white mothers adopted as part of what she called an “anti-racist parenting strategy”. understanding of the human condition of hatred. But through
understanding our experiences of hating and being hated, can we also
inform psychoanalytic theory and its application?
I take it to be a basic truth that everyone has experienced hating and
being hated. Hatred is an ordinary human experience that has extraordinary
results. Maybe it is because of those extraordinary outcomes that
we accord hatred the status of taboo. We seem to feel, in the common
culture, that if we speak hate’s name or invoke its memory we will suffer
a grim consequence. On the other hand, we fantasize that if we don’t
speak it, it doesn’t exist. The collusion of silence makes hatred unbearably
dangerous.
I think that all of us have our hate-stories to tell, if we dare. We all
have our hate-scars, some of which are better healed than others, and
some of us are better healed, as persons who have hated and been hated,
than others.
So I accept not only that our theory teaches us about hate, but also
that, if we converse with one another about our experiences of hatred,
we may demystify it, and that may allow us to inform and enliven psychoanalytic
theory about hatred, and may even ameliorate the effects of
hating and being hated within ourselves. We would undertake this piece
of work on behalf of our own personal and professional development,
as well as on behalf of our patients. In a small way, we would also
undertake it on behalf of the global community, where the monstrous
results of hatred proliferate.
I have had many kinds of conversations about hating and being hated.
Some go this way: “Those hateful things are in the past. Things are different,
now.” Here, defenses are mobilized against the apprehension of

complexity; there is a denial of the existence of the hatred. This kind of
conversation makes one feel deadened, if not actively hateful oneself.
Another conversation about hatred goes like this: “My experiences of
being hated are more interesting, damaging, pernicious, catastrophic,
and worthy of comment than yours.” Two experiences stand out as an
example of this conversation.
When I was defending my dissertation (White, 1977) on black identity
formation, I was trying to account for the effect of internalized negative
projections in the development of the black sense of self. One of the
readers said that the dissertation wouldn’t be worthy of inclusion in the
scientific literature unless I compared the black population to the identity
formation of other persecuted peoples; after all, Jews had been persecuted
and they didn’t have identity problems. Isador Chein, my chairman,
rest in peace, said “their persecution is their persecution, our persecution
is our persecution; they don’t compete.”
Another experience I had not long ago was with a friend who was
doing some work with what were then the start-up managers of the new
Holocaust Museum in Washington. We were talking about the importance
of maintaining the atrocities of racial hatred in memory.
