This leads to the worst of the lessons, and the one I find trickiest to overcome: that is, being a warrior for your personal integrity is lonely.

So, "Is Hillary Clinton Unconstitutional?" In a word, Yes -- or, to be more precise, a Secretary of State Hillary Clinton would be unconstitutional.
The Emoluments Clause of Article I, section 6 provides "No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been encreased during such time." As I understand it, President Bush's executive order from earlier this year "encreased" the "Emoluments" (salary) of the office of Secretary of State. Last I checked, Hillary Clinton was an elected Senator from New York at the time. Were she to be appointed to the civil Office of Secretary of State, she would be being appointed to an office for which "the Emoluments whereof shall have been encreased" during the time for which she was elected to serve as Senator. The plain language of the Emoluments Clause would thus appear to bar her appointment ... if the Constitution is taken seriously (which it more than occasionally isn't on these matters, of course).

Why should you care?  By Executive Order dated January 4, 2008, President Bush ordered the salaries of Cabinet Secretaries to be raised from $186,600 to $191,300.  And Sen. Clinton's current term runs from 2007 through 2012.   As such, umm, we've got a slight problem.
This has, as you may have suspected, happened before.  In 1909, President Taft sought to nominate Sen. Philander Knox (R-PA) to be his Secretary of State, despite the position's pay having been hiked during his term.  As the NYT reported on Feb. 11, 1909, "With President-elect Taft rests the decision in the queer constitutional tangle that threatens to prevent the accession of Senator Knox to the Cabinet. The Senate to-day passed a bill designed to remove the legal barrier which prevents Mr. Knox from accepting the Portfolio of State" by rescinding the previous pay raise.  [HT: StubbornFacts.]  [N.B. If you click on that link, do scroll down to the item at the bottom as well.]
In 1973, President Nixon nominated Sen. William Saxbe (R-OH) to serve as his Attorney General after the Saturday Night Massacre, but the AG's salary had been increased in 1969 during Saxbe's term.  Nixon persuaded Congress to lower Saxbe's salary to the pre-1969 level, and the "Saxbe fix" was born.
This was not without objection. Sen. Robert Byrd (D-WV) was opposed, saying that the Constitution was explicit and "we should not delude the American people into thinking a way can be found around the constitutional obstacle."  NYT liberal columnist Anthony Lewis weighed in as well on November 29, 1973:

Clinton's eligibility, redux

Submitted by Simon on Mon, 11/17/2008 - 1:24pm

Obama appointee eligibility series:
Clinton I Clinton II Clinton III Clinton IV Clinton IV(a) Salazar I

In a post last week, I suggested that the ineligibility clause may bar the appointment of Hillary Clinton as Secretary of State. Clinton was last elected to the Senate in 2006; if the pay of the Secretary of State has been increased in the last two years, it is a civil office under the authority of the United States, the emoluments of which have been increased during the time for which Clinton was elected, making her ineligible to be appointed to it under Article I § 6.1
Maryland Conservatarian now provides the missing link: the emoluments of the Secretary of State have increased during Clinton's term. At very least, the salary has risen from $183,500 in 2006 to $191,300 in 2008; even if this is a COLA increase, it still counts, as my previous post explains. This would seem to shut the door on Clinton, and on John Kerry, whose name has also been floated.

Article I § 6.1

1. Cf., e.g., the OLC's memorandum of May 30, 2002 (a member of Congress could be appointed to an office because it had no fixed emoluments, but the stated predicate of the opinion was that if the office had had emoluments, and if they had been increased during the member's tenure in office, the member would be ineligible under the ineligibility clause); 2 Decisions of the Comptroller of the Treasury 135 (1896) (appointment of Senator Ransom as Minister to Mexico before the expiry of his Senate term, when the salary thereof had been increased during Ransom's term, violated the ineligibility clause). Nor can Senator Clinton cure this disability through resignation, see 17 Op. Attorney General 365 (1881) (concluding that former Senator Kirkwood, who had resigned, was ineligible to be appointed to an office created by Congress after his resignation but during the term to which he had been elected); 12 Law Notes 222 (1909) (same); OLC memorandum of July 26, 1996, n.2 (collecting opinions and reaffirming same).

Zapata Corporation (NYSEZAP) is a holding company based in Rochester, New York, and originating from an oil company started by a group including the former United States president George H. W. Bush. Various writers have alleged links between the company and the United States Central Intelligence Agency.

[edit] Early business history

The company traces its origins to Zapata Oil, founded in 1953 by future-U.S. President George H. W. Bush, along with his business partners John Overbey, Hugh Liedtke, Bill Liedtke, and Thomas J. Devine. Bush and Thomas J. Devine were oil-wildcatting associates.[1] Their joint activities culminated in the establishment of Zapata Oil.[1] The initial $1 million investment for Zapata was provided by the Liedtke brothers and their circle of investors, by Bush's father and maternal grandfather—Prescott Bush and George Herbert Walker, and his family circle of friends.

That number represented 36% of all the crude brought to the surface that year in the country. W. J. Young, formerly of Oil City, was named Vice President of South Penn Oil in 1902. Pennzoil Company is a major energy company consisting of three main operating units: Pennzoil Exploration and Production Company, which has about 100 oil and gas fields in the Gulf of Mexico and the gulf coast, Texas, Arkansas, Louisiana, Canada, Azerbaijan, Egypt, Qatar, Australia, and Venezuela; Pennzoil Products Company, which operates two refineries in Shreveport, Louisiana, and Rouseville, Pennsylvania, and markets the bestselling motor oil in the United States; and Jiffy Lube International, Inc., the world's largest franchiser and operator of fast oil change service centers, with about 1,400 outlets. Pennzoil's history is one of mergers and takeovers. Though one of its earliest ancestors was a part of the vast Standard Oil interests until 1911, Pennzoil was not a major factor in the oil and gas industry until its 1965 takeover of United Gas Corporation, a company many times its size. In a high-profile corporate war, in 1988 Pennzoil accepted a settlement of $3 billion from Texaco after the latter was found guilty of interference in Pennzoil's failed merger with Getty Oil. The cash payment, larger than Pennzoil's total assets at the time, was a climax to Pennzoil's long and complex history of corporate gamesmanship, much of it engineered by the company's longtime chairman, J. Hugh Liedtke. Ironically, the Texaco settlement actually weakened Pennzoil, and the company was subsequently in danger of being taken over itself.

GEORGE BUSH and FAMILY, Part Five

by Sherman H. Skolnick
In the 1950s, George Herbert Walker Bush got into the oil business with his partners, the Liedtke brothers. Bush was assisted by his father, Prescott Bush, Sr., who was one of Adolph Hitler's bankers jointly with the Bush relative, George Herbert Walker.
Also greatly assisting Bush was Eugene Meyer who had reportedly built up his fortune by massive fraud misusing Liberty War Bonds, used to suck money out of common Americans with the then new, conspiratorial Federal Reserve, all used to finance and force Americans to fight in England and Europe's bloodbath, World War One. With his loot, Meyer bought the then failing Washington Post newspaper. Meyer's daughter, Katherine Graham, became publicly known as if she were the sole "owner" of the Post, despite the fact that British royalty had a large financial interest in the Post and later, sister publication Newsweek Magazine. Suppressed was the first edition of a book that showed the Washington Post was a front for the American CIA, Deborah Davis' book "Katherine the Great".
Much later, Bush brought in numerous British royalty into his oil ventures. Later, Bush was given honorary title by the Queen. Yet, the U.S. Constitution, Article 1, Section 9, forbids U.S. officials to have titles of nobility and be beholden to foreign kings and princes.

The head gardener, John Walquist, was making his Saturday afternoon rounds at 3:30 PM on November 20, 1915. About fifty feet from the house, on the south driveway, he found a package containing four one-pound sticks of dynamite.
A trip wire was set to trigger the bomb if the Archbold car drove over it. John D. Archbold was then taking a Hudson River pleasure sail on his yacht, the Vixen.

The estate, called Cedar Cliff, stood across Broadway from Transfiguration Church and is now a condominium development known as the Quay. If you look closely, you can see the old stone pillars marking the entrance. Archbold was a millionaire, the president of Standard Oil after John D. Rockefeller, and a Tarrytowner for roughly the last thirty years of his life.

The Tarrytown police believed that the bomb was the work of the International Workers of the World (the I.W.W.—the "Wobblies") and that the assassination attempt was precipitated by the execution of Joseph Hillstrom in Salt Lake City the day before. "Joe Hill" was an I.W.W. member and writer of working class songs who wrote on the eve of his death by firing squad, "Don't waste any time mourning—organize!" A year and a half earlier the I.W.W. had been to Tarrytown on two occasions, protesting the industrial policies of the John D. Rockefellers—junior and senior. This was followed by a fatal explosion at an illicit bomb factory in New York. The Tarrytown police combed the countryside for the bomber; armed guards were posted at the Archbold home, and security was tightened at other Tarrytown estates.

Q:  Is it true that George W. Bush has issued many more signing statements than any other president?
A:  No, Bill Clinton issued many more signing statements.  The controversy is about the kind of signing statements Bush has issued.
Q:  What kind of claims does Bush make in his signing statements that has people upset?
A:  In one frequently used phrase, George W. Bush has routinely asserted that he will not act contrary to the constitutional provisions that direct the president to “supervise the unitary executive branch.”  This formulation can be found first in a signing statement of Ronald Reagan, and it was repeated several times by George H. W. Bush.  Basically, Bush asserts that Congress cannot pass a law that undercuts the constitutionally granted authorities of the President.

Some go beyond the unitary theory to speak of unilateral Presidential authority. [2] One American political figure who has supported strong authority for decades is Dick Cheney. [3]

Evans was George W Bush's campaign manager in the last three elections and his chief fundraiser, pulling in millions from cronies in the oil patch. Before that he was CEO and Chairman of the Colorado-based oil company, Tom Brown Inc. Evans was also a Board member of Sharp Drilling, an oil industry contractor. As Commerce Secretary he will oversee the National Oceans and Atmosphere Administration (NOAA), the lead agency for US oceans and air. This will likely torpedo any worthwhile research or policy recommendations on climate change. And since 25 per cent of America's domestic oil and natural gas production comes from offshore drilling the industry must be glad to have a friend on the inside.

The fact that Evans and Tom Brown, Inc. were the beneficiaries of a Governor Bush-promoted oil company tax break did not unduly upset the Texas electorate. As Bush made clear early on during his 1978 congressional race, 'There's no such thing as being too closely aligned to the oil business in West Texas.'
"However," FPIF adds, "unlike the other big oilman of the administration, Dick Cheney, Evans has little experience in international exploration. He knows far more about the Permian Basin than the Caspian Sea. But Evans, loyalist that he is, is unlikely to create any international initiatives at Commerce that will go against the Bush foreign policy team."

Robert Bryce, writing for the March 20, 2000, Austin Chronicle, adds: [1]
"Evans' close ties to Bush and his contacts with other members of 'the Big Rich' made him a natural choice to be Bush's national finance chairman. And Evans has exceeded all expectations. He has coordinated an unprecedented fundraising drive for Bush. He helped organize the Pioneers, a group of Bush backers who each pledged to raise $100,000. The program has been remarkably successful. At last count there were more than 200 Pioneers who have reached the $100,000 goal." [2] See Bush's Rangers.

At the start of 2005, as Brody and Clare were still haggling over the e-mail, the Jenner team came across some explosive information. On Jan. 25, with jury selection set to start in three weeks, they found an old article disclosing that William Strong, Morgan Stanley's lead investment banker on the Sunbeam deal, had been indicted in Italy in 1995 for his alleged role in a corruption scandal. Strong was then head of Salomon Brothers International Ltd. The authorities had dropped the charges in 2001 for technical reasons, but Strong was not absolved until 2003. That meant that at the time of the Sunbeam deal, Strong faced criminal charges in Italy.
This was the first the Jenner lawyers had heard about this episode, even though a year earlier Maass had ordered Morgan Stanley to produce all documents relating to Strong's "truthfulness, veracity or moral turpitude." Strong's Italian indictment had received little, if any, press coverage in the United States. (A Nexis search turned up no articles from that time.) Strong was still a powerful figure at Morgan Stanley, serving as vicechairman of its investment banking operations and enjoying prominence in Chicago social circles. Morgan Stanley explained that it withheld documents mentioning the indictment because they weren't in Strong's personnel file. Maass would later say there was "no excuse" for not turning them over. Soon after they found the article, the Jenner lawyers filed a motion asking Maass to sanction the investment bank for discovery violations, including the incomplete e-mail production.

In May 2003, the process of discovery, in which each side seeks documents from the other, got under way. As is common in pretrial fencing, Morgan Stanley resisted some requests. The firm said it would be an invasion of privacy to hand over the personnel files of employees on the Sunbeam account, including William Strong, the account's top banker. Judge Maass sided in part with Morgan Stanley and limited the request to any documents about the employees' "truthfulness, veracity, or moral turpitude."
Unbeknownst to the Perelman team, Mr. Strong had been tried on bribery charges in Italy in the 1990s stemming from a previous job with Salomon Brothers. He was acquitted after a trial, while working for Morgan Stanley, but the firm didn't produce any documents on the matter. Mr. Perelman's lawyers stumbled across a news clipping in early 2005 while researching the case. Morgan Stanley said the information wasn't in Mr. Strong's personnel file and wasn't subject to discovery. The judge said there was "no excuse" for not providing documents about the Italian charges and found that Morgan Stanley "purposefully withheld" the information.

Mr. Strong's sudden resignation came as Salomon is struggling to regain its place in the investment banking business. His duties would be taken over temporarily by executives in London during the search for a replacement, Salomon said.
The 41-year-old investment banker gained respect on Wall Street during the late 1980's while at Salomon. He was named head of Salomon's European investment banking in 1991, and was given credit for rebuilding the once-moribund division into a healthy competitor. He was rewarded last October with the top job in international banking. In his job at Morgan Stanley, Mr. Strong will be responsible for the firm's corporate finance activities in the domestic offices.
On Wall Street, which trades in a cache of titles and bonuses, the move was a surprise.
"A guy with his track record could have gotten a comparable level job with any competitor," one Salomon executive said.
Salomon executives said that Mr. Strong, a native Midwesterner, told them he made the decision for family reasons.
In an interview yesterday, Mr. Strong said his decision to leave Salomon after 13 years was based largely on his admiration for Morgan Stanley. "If your goal in life is to be an investment banker," he said, "what better place to be than at Morgan Stanley?"

understanding our experiences of hating and being hated, can we also
inform psychoanalytic theory and its application?
I take it to be a basic truth that everyone has experienced hating and
being hated. Hatred is an ordinary human experience that has extraordinary
results. Maybe it is because of those extraordinary outcomes that
we accord hatred the status of taboo. We seem to feel, in the common
culture, that if we speak hate’s name or invoke its memory we will suffer
a grim consequence. On the other hand, we fantasize that if we don’t
speak it, it doesn’t exist. The collusion of silence makes hatred unbearably
dangerous.
I think that all of us have our hate-stories to tell, if we dare. We all
have our hate-scars, some of which are better healed than others, and
some of us are better healed, as persons who have hated and been hated,
than others.
So I accept not only that our theory teaches us about hate, but also
that, if we converse with one another about our experiences of hatred,
we may demystify it, and that may allow us to inform and enliven psychoanalytic
theory about hatred, and may even ameliorate the effects of
hating and being hated within ourselves. We would undertake this piece
of work on behalf of our own personal and professional development,
as well as on behalf of our patients. In a small way, we would also
undertake it on behalf of the global community, where the monstrous
results of hatred proliferate.
I have had many kinds of conversations about hating and being hated.
Some go this way: “Those hateful things are in the past. Things are different,

conversation makes one feel deadened, if not actively hateful oneself.
Another conversation about hatred goes like this: “My experiences of
being hated are more interesting, damaging, pernicious, catastrophic,
and worthy of comment than yours.” Two experiences stand out as an
example of this conversation.
When I was defending my dissertation (White, 1977) on black identity
formation, I was trying to account for the effect of internalized negative
projections in the development of the black sense of self. One of the
readers said that the dissertation wouldn’t be worthy of inclusion in the
scientific literature unless I compared the black population to the identity
formation of other persecuted peoples; after all, Jews had been persecuted
and they didn’t have identity problems. Isador Chein, my chairman,

is our persecution; they don’t compete.”
Another experience I had not long ago was with a friend who was
doing some work with what were then the start-up managers of the new

of maintaining the atrocities of racial hatred in memory.
