Personal life
Brian Littrell was born with a heart defect that brought him several times into hospital with life-threatening conditions - for two months alone when he was 5 years of age because of a bacterial infection. An open heart surgery in 1998 closed the hole he had in his heart, as he said on his "Hour of Power" interview in 2007. After that he founded the Brian Littrell's "Healthy Heart Club" for kids, a non-profit that assists children with heart conditions through medical, financial and practical help.

The former president of the foundation, Leonard F. Pickell, Jr., resigned in August 2004 shortly before the results of a three-month audit were to be announced. He was convicted of fraud in late September, having misused hundreds of thousands of dollars for unnecessary and undocumented expenses. As a result of the scandal and his indictment by the Attorney General's Office, the members of the board of the foundation were asked to resign in January 2005.
In January 2006 the reconstituted Board, under the direction of Interim President Edna Morris, initiated a search for a permanent President of the Foundation. In April that year Susan Ungaro, formerly editor-in-chief of Family Circle magazine, was appointed president.
In October 2007, the Board announced that Woodrow W. Campbell, senior partner at Debevoise & Plimpton, would be taking over Chairmanship of the board.
In March 2011 Susan Ungaro, President of the James Beard Foundation was appointed as Advisory member of the International School of Culinary Arts, Spain.
In anticipation of the James Beard Awards in May 2011, the Foundation is launching JBF LTD – a pop-up restaurant and food pavilion in New York City's Chelsea Market from April 12 – May 14.[1]

Excerpt:
Mr. Pickell stole more than $1.1 million in cash and payments for travel, flowers, rented limousines, parties, a BMW and other unauthorized personal expenses. Mr. Pickell, she said, had done "irreparable financial and reputational harm to the foundation."
From the time he joined the group in 1988, shortly after its founding, to his departure last summer, when he left the foundation in financial disarray, it grew from a debt-ridden organization to the most prominent culinary charity in the country, with $4.7 million in revenues.

Q & A With Susan Ungaro

susan_ungaro.jpgWith the 2008 James Beard Awards on the imminent horizon, we thought it would be an opportune time to check in with the foundation's newest president, Susan Ungaro.  Though Kim Cattrall from Sex and the City will dropping in to host the awards ceremony on June 8th, another woman runs the illustrious show year-round.  For twelve years, Ms. Ungaro served as the editor in chief for the award-winning women's magazine, Family Circle. An award winner herself, she has earned particular notice for her work from the William Paterson Legacy Awards and president Reagan's Office of Consumer Affairs.  Since having accepted the position of president at the James Beard Foundation two years ago, Ungaro has significantly revived its reputation and scholarship program.  Under her supervision, the James Beard's Greenwich Village townhouse has become a dynamic and prominent hub for over 200 visiting chefs, where New Yorkers have the unique opportunity to sample the cooking of chefs from all over the world.

Excerpt:
Kawasaki disease can only be diagnosed clinically (i.e. by medical signs and symptoms). There exists no specific laboratory test for this condition. It is difficult to establish the diagnosis, especially early in the course of the illness, and frequently children are not diagnosed until they have seen several health care providers. Many other serious illnesses can cause similar symptoms, and must be considered in the differential diagnosis, including scarlet fever, toxic shock syndrome, juvenile idiopathic arthritis, and childhood mercury poisoning (infantile acrodynia).[

Acrodynia is pain in the extremities (the hands and feet). It is an infantile disease that is characterized by lesions of the skin on the hands and feet, swelling in the extremities, digestive disturbances, and itching of the hands and feet, along with the cheeks and tip of the nose that are intensely pink.
Now a rare disease, acrodynia (painful extremities) primarily affects young children. The symptoms of irritability, photophobia (sensitivity to light), pink discoloration of the hands and feet, and polyneuritis (inflammation involving 2 or more nerves) can be attributed to chronic exposure to mercury. Acrodynia is frequently followed by arthritis involving multiple joints and muscular weaknesses.
HISTORY: Children initially become listless, drowsy, and irritable, with a tendency to cry. Anorexia (loss of appetite) and subsequent weight loss can occur. More than 50% of patients demonstrate photophobia (sensitivity to light). Hypotonia (loss of muscle tone), the ability to hyperextend or overextend the limbs, and atrophy (wasting) of muscles are noted. The child may refuse to walk.

FREQUENCY: In the U.S., Acrodynia was once widely prevalent; however, it is rare today because of the discontinued use of mercury in different preparations. Internationally, Acrodynia was especially common in Australia.
ALSO KNOWN AS: Chronic heavy metal poisoning, chronic mercury poisoning, dermatopolyneuritis, erythredema polyneuritis, Feer disease, Feer's disease, heavy metal poisoning, heavy metal toxicity, mercury poisoning, mercury toxicity, Pink disease, Swift syndrome, Swift's disease, Swift disease, Swift-Feer disease, vegetative neurosis,
ETIOLOGY: An allergic reaction to mercury.

John Travolta's Airport Lawsuit Takes Off

He loves to fly, and this blows.
John Travolta has sued the owners of the Florida airport where he's looking to land his jumbo jet, claiming that they falsified their 2006 records to show that the landing field could not accommodate large planes. (View the lawsuit.)

Travolta sues airport over his Boeing 707's ban
July 21, 2007 - 12:14PM
US actor John Travolta has sued the owners of the airport outside his home in an aviation community, claiming they lied to the Federal Aviation Administration to keep him from flying his Boeing 707 there.
In the federal lawsuit filed on Wednesday, Travolta claims Greystone Airport owners James and Christine Garemore falsely changed the airport's records in 2006 to indicate that it could not support large airplanes.
Travolta has a home at the Jumbolair Aviation Estates in Ocala and wanted to fly his Boeing 707 there. It is an exclusive, 222-hectare "fly-in community" with a $US6 million ($A6.83 million) runway - the largest, paved, private airfield in the United States.
The lawsuit is seeking an injunction requiring the Garemores to immediately withdraw the 2006 report and authorise flights with the airport master record as it existed before. It also seeks to nullify the report because of false or misleading information to the FAA and to prohibit "future baseless filings."
The lawsuit claims the airport owners are in an ongoing legal battle with the owners of Jumbolair. The misrepresentation was "carefully calculated ... to wreak financial harm" on Jumbolair and to force the plaintiff into legal action against Jumbolair to compromise its claims against the airport owners, the lawsuit said.
"The runway is not suitable for heavy aircraft. It is cracking and breaking," James Garemore told The Associated Press on Friday. "They are bringing this lawsuit against me and all I was doing was trying to maintain safety here."

TBW’s Farkas Guilty, Life Sentence a Possibility

  • Thursday, April 21, 2011
Lee Farkas isn’t exactly a household name in America, but this week he became the first mortgage executive of a once top ranked lender to be found guilty of a fraud with its roots in the housing bust.
Earlier in the week a jury found him guilty on all 14 counts tied to a $2.9 billion fraud scheme that lasted seven years and resulted in the failure of the Ocala, Fla.-based TBW, and played a role in the downfall of its chief warehouse lender, Colonial Bank.
Among the many charges levied against him, Farkas was accused of masterminding a scheme where nonbank TBW sold at least $400 million of fictitious mortgages to Colonial Bank.
Earlier this year TBW’s former treasurer, Desiree Brown, pleaded guilty, admitting that she worked with Farkas to generate money for the lender through the sale of "fictitious trades, which had no pool of loans collateralizing them, to Colonial bank."
Not only did TBW rank among the nation’s 10 largest lenders at one point, it was a top issuer of GNMA MBS. Both TBW and Colonial failed in the late summer of 2009, after an aborted takeover of the bank by TBW.
After a 10-day trial in the Eastern District of Virginia, the jury found him guilty on several different charges, including conspiracy to commit bank fraud, securities fraud, and wire fraud.
Farkas was first arrested in June of 2010. TBW was in business for about two decades.
At press time, his attorney William Cummings had not commented on a possible appeal.

Ex-Taylor, Bean Official Admits Guilt in $1.9 Billion Fraud

The former treasurer of Taylor, Bean & Whitaker Mortgage Corp., once the 12th largest mortgage lender in the U.S., admitted helping run a $1.9 billion fraud scheme that targeted the government’s Troubled Asset Relief Program and contributed to the failure of Colonial Bank.
Desiree Brown, 45, pleaded guilty in federal court in Alexandria, Virginia, to conspiring to commit wire fraud, securities fraud and bank fraud, and agreed to cooperate with prosecutors bringing Lee Farkas, former chairman of Taylor, Bean, to trial on April 4. Brown also settled civil charges with the Securities and Exchange Commission, the SEC said.
Until today, Farkas, 58, was the only person charged in what the government said was a massive scheme to deceive financial firms and TARP by covering up shortfalls at Taylor, Bean, once the largest non-depository mortgage lender in the U.S., according to the SEC’s statement on the case. Farkas was indicted on 16 counts in June and faces the possibility of spending the rest of his life in prison, according to a Justice Department statement.
“Were there other people besides Mr. Farkas who were involved in this scheme,” U.S. District Judge Leonie M. Brinkema asked Brown at the plea hearing?
“Yes ma’am,” Brown answered.

Excerpt taken from Taylor Bean & Whitaker Press Release:
TAYLOR BEAN MUST CEASE ALL ORIGINATION OPERATIONS EFFECTIVE IMMEDIATETLY"TAYLOR, BEAN & WHITAKER MORTGAGE CORP. (“TBW”) RECEIVED NOTIFICATION ON AUGUST 4, 2009 FROM THE U.S  DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,  FREDDIE MAC AND GINNIE MAE (THE “AGENCIES”) THAT IT WAS BEING TERMINATED AND/OR SUSPENDED AS AN APPROVED SELLER AND/OR SERVICER FOR EACH OF THOSE RESPECTIVE FEDERAL AGENCIES.  TBW HAS UNSUCCESSFULLY SOUGHT TO HAVE THE TERMINATION/SUSPENSION DECISIONS OF EACH OF THOSE AGENCIES REVERSED.    AS A RESULT OF THESE ACTIONS, TBW MUST CEASE ALL ORIGINATION OPERATIONS EFFECTIVE IMMEDIATELY.  REGRETTABLY, TBW WILL NOT BE ABLE TO CLOSE OR FUND ANY MORTGAGE LOANS CURRENTLY PENDING IN ITS PIPELINE. TBW IS COOPERATING WITH EACH OF THE AGENCIES WITH RESPECT TO ITS SERVICING OPERATIONS AND EXPECTS TO CONTINUE TO SERVICE MORTGAGE LOANS AS IT RESTRUCTURES ITS BUSINESS IN THE WAKE OF THESE EVENTS.  WE UNDERSTAND THAT THIS COULD HAVE A SIGNIFICANT IMPACT ON OUR VALUED EMPLOYEES, CUSTOMERS AND COUNTERPARTIES, AND ARE VERY DISAPPOINTED THAT A LESS DRASTIC OPTION IS UNAVAILABLE."
The closure follows actions taken by HUD yesterday in response to TBW’s failure to submit a required annual report and to disclose "certain irregular transactions that raised concerns of fraud."  HUD also proposed to bar two members of senior management from dealings with the US Government for 18 months owing to HUD’s allegation the two submitted false information to the agency.

According to correspondence received by market participants, today is the last day of operations and most employees will be terminated by close of business.  The precipitous nature was also noted in the communications from senior management in which it was said that all steps were taken to try to prevent the closing of the doors.

As has been a common theme in the wave of mortgage bank closures over the past 2 years, many employees when questioned this morning, had nothing to offer besides “business as usual…”  Normal morning emails with rate sheets, guidelines, and turn-times for underwriting went out this morning, and many employees told us directly or indirectly they didn’t know anything about TBW closing their doors.

Perhaps an even more disturbing common theme for certain parts of the mortgage origination community is to see yet another king of the “private mortgage company” hill go out of business.  In 2006, Aegis Wholesale touted their status as the largest private mortgage company in the US.  More specifically, this means that non-bank/wholesale origination channels are dealt another severe blow as they are now losing the biggest player in that segment.

A closure like TBW, combined with the potential precedent set not only by HUD’s actions, but also their aggressive verbiage, adds to the already sizeable concern that the wholesale channels will continue to get pushed out of the picture in favor of the largest retail banks.  Although that is likely a bleak outlook for some, giant banks like Wells Fargo “remain supportive of the wholesale channel”—at least for now.
TBW is the third largest endorsement lender of FHA-insured loans and the eighth largest Ginnie Mae issuer with $24 billion, or 3%, of current outstanding Ginnie Mae fixed rate securities.
According to JP Morgan, Bank of America will take over TBW's FHA loan servicing duties.

Boy In The Bubble Lyrics
It was a slow day
And the sun was beating
On the soldiers by the side of the road
There was a bright light
A shattering of shop windows
The bomb in the baby carriage
Was wired to the radio

These are the days of miracle and wonder
This is the long distance call
The way the camera follows us in slo-mo
The way we look to us all
The way we look to a distant constellation
That's dying in a corner of the sky
These are the days of miracle and wonder
And don't cry baby, don't cry
Don't cry

It was a dry wind
And it swept across the desert
And it curled into the circle of birth
And the dead sand
Falling on the children
The mothers and the fathers
And the automatic earth
These are the days of miracle and wonder
This is the long distance call
The way the camera follows us in slo-mo
The way we look to us all
The way we look to a distant constellation
That's dying in a corner of the sky
These are the days of miracle and wonder
And don't cry baby, don't cry
Don't cry

It's a turn-around jump shot
It's everybody jump start
It's every generation throws a hero up the pop charts
Medicine is magical and magical is art
The Boy in the Bubble
And the baby with the baboon heart

And I believe
These are the days of lasers in the jungle
Lasers in the jungle somewhere
Staccato signals of constant information
A loose affiliation of millionaires
And billionaires and baby
These are the days of miracle and wonder
This is the long distance call
The way the camera follows us in slo-mo
The way we look to us all
The way we look to a distant constellation
That's dying in a corner of the sky
These are the days of miracle and wonder
And don't cry baby, don't cry
Don't cry
