Florida-based Del Monte Fresh Produce is striking back at the FDA with a lawsuit after the agency halted imports of its Guatemalan cantaloupes, saying they may be contaminated with salmonella. Such a lawsuit is extremely rare, and the threat of litigation could make officials more reluctant to tell the public about the possibility of contamination in food.
"If this case is successful from an industry perspective, it will change the attitude of regulators," said former FDA assistant commissioner David Acheson, now a food safety consultant. "They will obviously be more reluctant."
Michael Doyle, the director for the Center for Food Safety at the University of Georgia who has advised the FDA on food safety issues, said the lawsuit could set a dangerous precedent.

Last week, the biotech food giant Monsanto announced it is marketing a new variety of genetically engineered (GE or GMO) food: a sweet corn intended for sale as frozen and/or canned food. Unlike most previous GMO crops, which are primarily used for animal feed or highly processed food ingredients (like corn oil or corn syrup), this new sweet corn is intended for direct human consumption.
This is especially worrisome since the Monsanto corn contains genes that produce a toxic insecticide. When consumers eat this GMO variety, they’ll be eating a toxic pesticide with every bite.
And of course, like other GMO foods, this new frozen and canned corn will not be labeled, so shoppers cannot know when they may be buying this experimental new food. For about a decade, Monsanto tried to bring GMO wheat to market – only to face opposition from food companies who stated they would refuse to buy the GMO crop. For example, General Mills noted its rejection of GMO wheat, since its consumers would refuse GMO wheat foods. Ultimately Monsanto was forced to abandon its development of GMO wheat.

In late December, he received notice from Western Australia’s Department of Agriculture and Food (DFAWA) that 293 hectares – later found to be 325 hectares – of his organic farm had been contaminated by Roundup Ready canola. The GM canola arrived on his property from a neighboring farm.

Organic Certification Revoked

Australia’s leading organic certifier, the National Association for Sustainable Agriculture, Australia (NASAA), suspended certification on the 70% of Mr. Marsh’s farm containing the GM canola.
Steve Marsh stands to lose thousands of dollars this year because his formerly organic crop has been downgraded to conventional. Because GM seeds can remain viable for many years, he may have no choice but to continue receiving conventional prices for his crops for several years. He stands to lose a lot more than just the thousands of dollars he will lose this year.

But the Agriculture Minister Looks Out for Small Farmers, Right?

Agriculture Minister Terry Redman has said organic standards are to blame for Mr. Marsh’s financial loss. If the NASAA allowed GM crops to be labeled as organic, this wouldn’t be a problem. Redman has urged Mr. Marsh to petition NASAA to relax their standards.
Agriculture Minister Redman stated last year that non-GM farmers would not be compensated for any contamination by GM crops.

Monsanto Will Cover Legal Fees for the GM Farmer

Monsanto, for their part, has agreed to finance the legal defense of the farmer whose GM canola caused the problems. The GM farmer left a buffer of five meters (16.4 feet) between the Roundup Ready canola and other fields, which is the law in Western Australia.
